SAS Le Kaïla, representing le Kaïla Hotel***** in Méribel – France – provides hotel and restaurant services.

ARTICLE I : Scope of Application of the General Terms and Conditions of Sale

These General Terms and Conditions of Sale (hereinafter "Terms and Conditions") shall apply to all services provided by the Establishment.

Any booking of services provided by SAS Le Kaïla implies the client's full and unreserved acceptance of these Terms and Conditions.

The client acknowledges having reviewed the General Terms and Conditions of Sale provided by SAS Le Kaïla, and confirms having requested and obtained all information necessary to make a fully informed booking. Given the diversity of our rooms, variations in configuration and decor may exist from one room to another. General descriptions and photographs of our rooms are presented on our website and other media for illustrative purposes only. For further details, please do not hesitate to contact us. No claim regarding such variations shall be accepted, provided that the essential characteristics of the service offered to you remain unaffected.

These General Terms and Conditions of Sale apply to all booking channels offered by SAS Le Kaïla (including online bookings, telephone, email, and in-person walk-ins, etc.), excluding bookings made through third-party intermediaries.

ARTICLE II : Pricing Terms & Offers

Room Prices

The rates provided at the time of the booking request shall remain valid until the option's expiration date. Past this deadline, they are subject to change. Our prices are stated in euros and are inclusive of all taxes (TTC), with the exception of the tourist tax (taxe de séjour) and any ancillary services payable at reception. Prices may be adjusted in the event of legislative and/or regulatory changes that could lead to price variations, such as updates to the applicable VAT rate, the introduction of new taxes, etc.

Only the price specified in the booking confirmation shall be contractually binding.

The tourist tax rate applied shall be the one in force as determined by the decree of the Mairie des Allues, and is charged per day, per person aged 18 and over. Rates offered on a "Bed & Breakfast" basis include:

  • Accommodation
  • Buffet Breakfast served at the hotel restaurant, or Continental Breakfast served in-room. Certain in-room services may incur an additional charge; please refer to the current rate card.
  • Access to the aquatic area (swimming pool, sauna, hammam) and fitness area.
  • Access to the children's area.
  • Intra-resort shuttle services.
  • Wi-Fi access.

Promotional & Package Stay

Special Offers and Rates:

Special offers and rates provided by the hotel are granted on a personal and temporary basis. These offers are non-transferable, carry no obligation of renewal, and cannot be combined with any other promotional offers.

Services Included in Packages:

NUXE Spa: It is the Guest's responsibility to check spa availability and book any treatments that may be included in the stay. In the absence of a booking by the Guest, SAS Le Kaïla will book the spa treatments included in the package on the Guest's behalf, if applicable.

Restaurants: It is the Guest's responsibility to check restaurant availability and book any meals that may be included in the stay. In the absence of a booking by the Guest, SAS Le Kaïla will book the meals on the Guest's behalf in one of the restaurants included in the package, or in a partner restaurant, if applicable.

In the event of a package or special offer booking, any unused service included in the package or special offer shall not be eligible for any discount, will not be refunded, and does not entitle the Guest to any postponement or compensation.

ARTICLE III : Booking, Modification & Cancellation Terms

Terms and Conditions for Booking

The Guest undertakes, prior to making any booking, to complete all the information requested to establish the reservation. The Guest certifies the truthfulness and accuracy of the information submitted.

Booking Terms and Conditions for fewer than 6 rooms:

All bookings shall be confirmed by an initial payment of earnest money (deposit) equivalent to 50% of the total amount due for the stay. Subsequently, the remaining balance of the stay shall be paid 45 days prior to the arrival date.

If the booking is made less than 45 days before the arrival date, full prepayment of the stay shall be required to confirm the reservation.

Special Booking Terms and Conditions for 6 rooms or more:

All bookings shall be confirmed by an initial payment of earnest money (deposit) equivalent to 50% of the total amount due for the stay. Subsequently, the remaining balance of the stay shall be paid 90 days prior to the arrival date.

If the booking is made less than 90 days before the arrival date, full prepayment of the stay shall be required to confirm the reservation.

Payment

The total amount of the stay is due before arrival at the hotel and in accordance with the specified dates.

In the event of failure to comply with these payment terms, the booking shall be cancelled.

Should Guests arrive without the hotel having received full payment for the stay prior to arrival, the hotel reserves the right to refuse access to the rooms.

Capacity:

Accommodation is provided for a specific occupancy capacity, as defined in the booking confirmation document.

Unless confirmed in writing by the booking department, the addition of an extra bed in the rooms is not permitted.

If the number of occupants exceeds the maximum predefined capacity permitted by the safety standards in force, the hotel reserves the right to refuse access to any additional persons for security and insurance reasons. In such instance, any modification or termination of the contract shall be deemed to be at the Guest's sole initiative.

It is reminded that a young child is considered a full occupant.

Room Allocation:

Unless expressly confirmed in writing, it is not possible to guarantee a specific room number, floor, or exact orientation of the room in advance.

Check-in Terms and Key Handover

The room(s) shall be made available to the beneficiary from 4:00 PM and must be vacated by 11:00 AM on the day of departure. Any failure to vacate the room within this timeframe may result in the billing of an additional night or supplementary fees.

A valid credit card and official identification must be presented upon arrival to guarantee any ancillary charges (extras). Failing this, SAS Le Kaïla reserves the right to refuse access to the accommodation.

In accordance with the regulations in force, the Guest will be required to complete an individual police registration form upon arrival.

The Guest expressly authorizes SAS Le Kaïla to use the banking and credit card details provided during booking or upon arrival to settle any outstanding amounts due in connection with the stay, including but not limited to cancellation fees, no-show fees, early departure fees, services consumed, documented damages, or any other amount owed under the contract.

Payment Terms

At the end of the stay, the earnest money (deposit) shall be deducted from the final invoice for the period initially booked. The balance invoice is payable on the day of departure. Unless otherwise expressly agreed, no extension of payment deadlines shall be granted.

In the event of non-payment, the hotel reserves the right to charge any outstanding amounts to the credit card provided by the Guest as a guarantee upon arrival.

SAS Le Kaïla reserves the right to apply additional fees in the event that out-of-pocket expenses (disbursements) are settled by credit card.

Cancellation and Modification Terms

Terms and conditions for cancellation of less than 6 rooms

In the event of partial or total cancellation over 90 days from the arrival date, no penalty is retained and deposit paid is refunded, minus 5 % administration fees In the event of partial or total cancellation between 90 days and 61 days before the arrival date, deposit paid is converted into a credit to be used during the current season minus 5 % administration fees. In the event of partial or total cancellation between 60 days and 46 days before the arrival date, the 50 % deposit paid will be retained as cancellation fees.

In the event of partial or total cancellation from 45 days before the arrival date, the total pre-payment for the stay will be retained as cancellation fees.

All cancellations should be notified to the booking team by letter or email. The date of receipt of the letter or email will constitute the date of cancellation.

Terms and conditions for cancellation of special bookings of 6 rooms and more

Up to 91 days before the arrival date, a one night penalty is retained, per week and per room booked. Between the 90th day and the date of arrival, the total pre-payment for the stay will be retained as a cancellation fee.

In the event of a no-show:

In the event of a no-show, the booking will be automatically cancelled the following day at midday, notwithstanding any other notification in writing or by telephone confirmed by email within 24 hours. The total amount of the stay will be retained. The hotel reserves the right to re-allocate all rooms within 24 hours.

Terms and conditions for reimbursement:

Reimbursement is undertaken by bank transfer in line with the terms and conditions of cancellation, within a maximum of one month after written confirmation of the cancelled booking and upon presentation of the bank details for the person making the booking. The hotel may not be held liable in the event of any personal, financial, political or weather conditions which lead to cancellation. It is recommended that you take out cancellation insurance with your travel agent or insurer.

Force Majeure & Relocation

The Accommodation Provider shall not be held liable for the unavailability, closure, partial operation, or modification of operating hours of ski lifts, ski slopes, shops, transport, activities, or resort infrastructure, as these services are operated by independent third parties.

In the event of force majeure, the Establishment reserves the right to arrange alternative accommodation, in whole or in part, for the Guests in a nearby hotel of an equivalent category for services of the same nature. The costs inherently related to the relocation transfer shall be borne exclusively by the Establishment, which cannot be held liable for any further compensation.

The Establishment may release itself from its obligations or suspend their execution should it find itself unable to fulfill them due to the occurrence of a force majeure event, including but not limited to the total or partial destruction of the property, strikes, etc. The Accommodation Provider may cancel or postpone the booking in the event of force majeure.

The Accommodation Provider shall notify the contracting party as soon as practicable of its inability to execute its contractual obligations due to a force majeure event. The Accommodation Provider shall not be held liable for any cancellation or postponement resulting from a force majeure event.

In the event of force majeure or an act of God duly established and rendering the stay impossible under the initial conditions, the Establishment will endeavor, subject to availability and prior written agreement, to offer alternative solutions to postpone the validity of the nights booked.

Interruption of Stay:

In the event that the stay is interrupted for any reason whatsoever beyond the hotel's control, the Guest shall not be entitled to claim any refund. To cover this eventuality, it is highly recommended to purchase an individual insurance policy.

ARTICLE IV : Theft & Damages

The Guest shall be responsible for the safekeeping of their personal belongings and equipment. An in-room safe is available for this purpose. The Guest must immediately inform the Establishment of any damage caused by their action. The Guest shall be held liable for all damages caused by themselves or by persons under their care, and undertakes, in the event of damage to the premises made available (including rooms and common areas such as the swimming pool, jacuzzi, lounge, restrooms, etc.), to bear the full cost of restoration.

Any damage, missing equipment, abnormal fouling, or necessity for exceptional cleaning shall be subject to billing, covering the costs of repair, replacement, or specialized cleaning, as well as the loss of business revenue resulting from the temporary unavailability of the premises or equipment concerned.

ARTICLE V : Use of Rooms & Services

The Guest undertakes not to invite any person whose behavior is likely to cause prejudice to the Establishment, the latter reserving the right to intervene if necessary. The Guest shall not bring any outside beverages or food items onto the premises without prior authorization from management. The Guest undertakes to respect all guidelines and regulations of the Establishment (including, but not limited to, the smoking ban).

Our rooms are strictly non-smoking: In accordance with the provisions of the French Public Health Code governing smoking restrictions in public places, any Guest failing to comply with this provision shall be immediately billed a flat fee of 150 euros for damages and to cover additional cleaning costs. If the violation is discovered after the Guest's departure, SAS Le Kaïla reserves the right to charge said amount to the at-fault Guest's credit card. An invoice shall then be issued and sent to the Guest.

Any behavior contrary to good morals, disrupting the stay of other guests, compromising the safety of individuals or property, or violating the internal house rules may result in immediate eviction from the Establishment without any refund.

Lost Property:

Left-behind items are stored for a maximum period of six months. Any potential return shipping shall be carried out at the Guest's exclusive expense, risk, and peril.

Booking of Ancillary Services:

Any booking made by the hotel services on behalf of the Guest, whether for an in-house service or an external service (activity, transport, restaurant, partner provider, or any other service), must be honored by the Guest. In the event of late cancellation, modification, or a no-show, the fees charged by the provider concerned may be fully re-billed to the Guest.

ARTICLE VI : Minors & Legal Capacity to Contract

Attention is drawn to the fact that the Establishment does not qualify as a Collective Accommodation for Minors under the French Code of Social Action and Families, and is not suited to host group or individual stays outside the family home for minors under the age of 18 who are unaccompanied by their legal guardians. SAS Le Kaïla reserves the right to refuse access to any room booked in violation of this requirement for minors under the age of 18 unaccompanied by their legal guardians upon arrival at the reception of SAS Le Kaïla, and to proceed with the immediate cancellation of the stay. Under the same conditions, SAS Le Kaïla may, at any time prior to the start of the stay, cancel the booking should it be discovered that the room is intended to accommodate minors under the age of 18 unaccompanied by their legal guardians.

Every Guest acknowledges having the full legal capacity to contract, meaning they have reached the legal age of majority and are not subject to any legal guardianship or protective supervision order (curatelle or tutelle).

ARTICLE VII : Pets policy

Pets (dogs and cats) are allowed within the Establishment subject to an additional nightly fee. They are permitted in common areas provided they are kept on a leash, but are strictly prohibited in the restaurants, as well as in the aquatic area and the spa. The Guest assumes full civil and financial liability for any damage, nuisance, or injury that may be caused by the animal within the Establishment.

ARTICLE VIII : After Sale

The Establishment's teams are at the Guest's disposal during the stay to respond to requests, resolve any potential malfunctions, and ensure the Guest fully enjoys their stay. Front desk personnel should be contacted for any requests or notifications.

Any issue encountered during the stay must be reported to the reception desk as soon as practicable to allow the Establishment the opportunity to remedy it. No post-stay claim shall be validly considered if the Establishment was not given the opportunity to intervene during the Guest's stay.

Any claim arising after the stay must be submitted within a maximum period of 15 days following the end of the said stay:

To facilitate and expedite the processing of the claim, the Guest is requested to specify the name under which the booking was made, the booking confirmation number, the exact dates of the stay, the room category, and to attach all relevant supporting documents. Delayed notifications may affect the Establishment's ability to resolve the matter effectively.

It is the Guest's responsibility to check, prior to booking, for any local events (festivals, public events, holiday celebrations, etc.) that may impact the course of their stay. No subsequent claims related to such events shall be accepted.

Mediation & Governing Law:

Any dispute, claim, or litigation relating to booking procedures or the stay itself shall be governed by French law and shall fall under the exclusive jurisdiction of the competent courts of the Department of Savoie (73), France.

In the event of a dispute between the professional and the consumer, they shall endeavor to reach an amicable settlement. Failing an amicable agreement, the consumer has the right to refer the matter free of charge to the consumer mediator designated by the professional, namely the Association des Médiateurs Européens (AME CONSO), within a period of one year from the date the written claim was sent to the Establishment.

ARTICLE IX : Data Protection & Privacy

The Guest's personal data is collected by SAS Le Kaïla, acting as the data controller, and is integrated into its database. Certain data is mandatory for managing the booking and will also be used to send information and/or promotional offers regarding the establishment's products and services. In accordance with the General Data Protection Regulation (GDPR) and the amended French Data Protection Act (Loi Informatique et Libertés), the Guest has the right to access, rectify, and erase their data, as well as the right to object to commercial marketing. These rights may be exercised by sending a postal letter to the following address: SAS Le Kaïla, 124 Rue des Jeux Olympiques, 73550 MERIBEL, France. Information relating to the processing of personal data, retention periods, and detailed procedures for exercising these rights are specified in SAS Le Kaïla's Privacy Policy, available upon request.

ARTICLE X : Translation

The hotel's terms of sale and cancellation are drafted in French and translated into English for the benefit of English-speaking guests. The parties expressly agree that the French version shall prevail over any translation drafted in another language.
